New Jersey’s mandatory arrest provision in its domestic violence statute may be well intentioned, but it compels police officers to arrest suspected abusers on the scantest evidence. Specifically, the law says an officer must arrest when “the victim exhibits signs of injury caused by an act of domestic violence.” And what does it mean to exhibit signs? The statute says this can include “manifestations of an internal injury suffered by the victim.” The statute doesn’t define “manifestations,” so that’s wide open to interpretation. Would doubling over in apparent pain be a manifestation of internal injury? Would that level of “proof” open the door to fakery?
